Typical over charging. happens all the time.
i know it happens all the time... it's ridiculous tho... why tarnish a kid's record like this? even tho this stuff usually gets wiped clean if the charges are later dropped, u still expose this kid to the process of getting arrested, getting booked & going to holding to be processed... & i'm pretty sure the fact that you were arrested still shows up on your record if someone runs an indepth background check on you so that could be an issue for a future job... if u'r gonna charge someone, charge them for what you SAW them do, not what u THINK they did, unless u have witnesses & physical evidence to support those charges... the story said the cop saw him walking out from behind the house, not that the cop saw him walking out OF the house... that's a huge difference there... if there's no evidence that the kid was ever inside the house at all then charging him w/breaking & entering is total BS.
