Attorney drops bombshell accusations, argues for probation for Donaghy

NEW YORK -- Disgraced basketball referee Tim Donaghy told investigators in the NBA betting probe that relationships among officials, coaches and players "affected the outcome of games," his attorney said. The league said the charges were unfounded.

Donaghy's attorney made the assertions in a letter filed in U.S. District Court in Brooklyn on Monday, in which he argued that his client should be sentenced to probation because he fully cooperated with prosecutors and has been undergoing treatment for his gambling addiction.

The attorney also suggested that Donaghy told investigators about the gambling activities of other NBA officials and about a referee that passed "confidential" information to an unidentified coach.

The attorney, John F. Lauro, wrote that the U.S. attorney's office for the Eastern District agreed to plea agreements with other defendants in the case, even though his client told investigators about NBA matters outside of the government's initial investigation. Lauro said the disparity in treatment could not be fully explained because prosecutors have "surrounded this case with a cone of silence."

The U.S. attorney's office said Tuesday it has no comment.

In a footnote, the attorney suggested that the NBA might have "pressured" the attorney's office "into shutting down this prosecution to avoid the disclosure of information unrelated to Tim's conduct."

"The letter filed today on Mr. Donaghy's behalf contains an assortment of lies, unfounded allegations, and facts that have been previously acknowledged, such as the fact that certain NBA referees engaged in casino gambling in violation of NBA rules," said Joel Litvin, the NBA president for league and basketball operations, in a statement. "The letter is the desperate act of a convicted felon who is hoping to avoid prison time."

The 42-year-old veteran referee pleaded guilty last August to felony charges for taking cash payoffs from gamblers and betting on games he officiated. Donaghy's sentencing was pushed back to July 14 on Monday; by law, he faces up to 25 years in prison and a $500,000 fine, though the term could be much lower under sentencing guidelines.

While citing Donaghy's commitment to his family, charitable activities and positive feedback for his career as a referee prior to his "tragic fall from grace," his attorney said that his client's "aberrant conduct" can only be understood in the context of his gambling addiction, a "crippling disease, which prevented him from exercising complete rational self control."

Lauro wrote that Donaghy is taking steps to get treatment for his condition, including therapy with a gambling counselor and attending Gamblers Anonymous meetings.

"Without a doubt, Tim made significant errors in judgment, but he also tried to right the wrongs of his conduct by assisting the government and seeking treatment for his disorder," Lauro wrote.

That info wouldn't surprise me at all. I have watched many games closely over the years and it's easy to see some of this stuff unfold.

Give me my props, I have said this was going on for the longest and it behooves me that nobody else has commented on this.

It's easy to see guys on the take, chauncey billups has to be one of the guys . He's too good to pull some of the mess he showed in big games when they lost.

Does everyone remember the facial expression David "the don" Stern showed when he made his statement about it was just one "rogue" official.

Stern that day looked like he was just sentenced life in prison.

I bet the halftime announcers won't talk to much about the Donaghy allegations.

Remember in the beginning of the allegations word was there were many involved and everybody associated with the league was afraid...this is the reason why.The timing of it all, on draft night and a playoff game hmmm, lost in the sauce.

David Stern contradicted himself by saying everything is already out on what happen and he's just awaiting the sentencing of Tim Donaghy.

So why does he want to speak to donaghy again before sentencing to see what else he has to say?

When the NBA Refs got caught turing in their plane tickets for money it was sweeped under the rug by stern and the NBA.

IMHO this is worst than the brawl in AUBURN HILLS between the pistons and the pacers. They said players , refs and coaches and players are involved in some type of NBA GAMBLING AND CHEATING.

I love the game of basketball like the next man, but this is outrageous.

Boston Redsox and shoeless joe jackson almost brouhgt down the game of baseball and this latest bombshell has the same potential but it's being potentially swept under the rug .

When has only one person been involved in gambling, there has to be other players whether coaches refs or players.

I hope donaghy spills his guts and name names regardless of his fate.

With our luck, it will probably come down to our Knicks to have made the illegal deals.

Just like the steroids probe that indicted our Yankees and Mets for the most part in baseball. By a boston man, of all things.
I'll never trust this' team again.

I'm just appalled how they are trying to sweep this case under the rug...We are talking about the Integriety of the NBA Professional game of Basketball...this isn't WWE we are talking about!

Where are all the NBA purist on this site????

Rats(donaghy) are usually honest and anything a attorney says comes from his deal taking client can be accepted as the gospel. All deals are retracted in the case of any untruths.

I Watch the NBA with one eye open now and that is the part of suspicion that has been brought on by this scandal. I am suprised the fallout has not been greaterby NBA purist.

Allegations are one thing, but did the rat provide names?

Unless he can do that, why would they go on a witch hunt?

Im down to tear it down if there is a bonafide link of evidence.

No props to Playa until there are facts. Rats usually are gonna spill everything they can to get off as much as possible, and if he named names thats one thing.

How can the league pressue a DA if there is evidence. If not, then close it down. The rat can do huge damage with "allegations" if not legit.

What you are saying is if Donaghy comes out and name names that he has nothing to worry about, don't you think his life would be in GREAT DANGER ?

He has a lot to think about with bringing down a billion dollar business.

Do you have any idea the type of treatment donaghy would recieve in prision, even if he does just 5 yrs and WINDS UP WITH A book deal ?

The point of stern wanting to talk to donaghy before sentencing sounds very guilty to me.
