I'd rather have a liberal but that obviously won't happen with the Whitehouse and Congress controlled by the right wing. I highly doubt ideology is going to be enough to defeat his nomination unfortunately.

He's extremely well qualified, and is no more ideological than Ginsburg or Breyer who were confirmed unanimously.

That's patently false. In the 70s, Ginsburg wrote a law review article in which she argued that Roe was wrongly decided. Point me to anything that Alito has written that is remotely analagous to that.

In addition, Sen. Orin Hatch recommended Ginsburg to President Clinton.

Breyer is a technocrat.

The point isn't whether or not Alito has written about Roe, it's about taking a position on an issue that runs counter to one's ideological expectations.

If one wants to argue that Alito is no more ideological than Ginsburg, they should be able to point to an issue on which Alito has shown that his position runs counter to the typical idelogical conservative, as Ginsburg did in the article I cited.

btw, I think the terms liberal and conservative are meaningless at this point. The issue is really the rights of the individual v. the power of the state.

Unfortunately, Alito almost always comes out on the side of the state. That would concern me whether the president is Bush or Clinton, George I or George II, Bill or Hillary.

The terrible truth is that our federal goverment...
specifically the Executive Branch, has consolidated alot of power and has assumed even more powers that were never even granted to it by Congress or the constitution.
These grave matters of law will be decided in the near future on our nation's highest court.
Alito's views on the power of the state are critical to our future freedoms as Citizens of this great country.

Yeah, I know Alito too. Hell, we dropped acid together like 50 or 60 times back in the day. He was cool too, until he got heavy into Crank. Then we lost touch.

Alito, IMO, is a made man. He's heading to the court to protect da family. I wouldn't mind him so much on a lower court but, given that the current adminstration is likely to end up in the court soon, I'd much prefer a judge with both more life experience and more independence.

That said, I'm so happy to see these political topics show up once in a while on this board. It makes me even happier that some of these brief discussions are as well-informed as the Knicks talk here.

Alito's problem is not that his views run to the far right but that his pro business, limited individual rights views run counter to established and developing legal principles. I cannot think of any recent nominee who has been overturned more or whose dissenting opinions have failed to get affirmed at higher levels. Basically he's as steadfast and as hardined as the questionable administration seeking his appointment.
