This is like something out of the AIG stuff we heard about AIG selling other people's loan debts for money.

Imagine the Marbury situation, sort of, where he wants off the team, but instead where his contract was sold to the IRS as an asset to pay of debt the Knicks owe.

Rubio had refrained from filing a lawsuit and instead had asked an arbitrator to settle the case. The transfer of his buyout to the government appears to have changed that.

good find. this situation seems crazy. it's clear that the team is in financial turmoil and trying to use rubio (obviously one of their few assets) to get out of debt.

you know, as crazy as all this stuff is, you can rest assured that it will all be a distant memory very soon..

in some way it will be resolved and when rubio is tearing up the league with his sweet passing no one will remember any of this.

Not unusual. Done everyday. Debts and rights to assets can be assigned at any given moment unless you otherwise specify in your contract that such rights can't be transfer. A contractual obligation is considered an asset. Not sure what his grounds for any lawsuit can be if he didn't specify that his contract can't be sold which I seriously doubt.

I don't know Cosmic. Signing a contract at 16 is a bit of an out in my mind. At least it would be in the US (most litigious place on earth). I think with his salary being what it is, Rubio's lawyer does have an argument. I'm not saying he is in the right, but the law might see things different. He made 80k, or 160k (might have doubled it I read) and his buyout is 6 million. That is like waaaay too high.

I think it's at least fair to say that some negotiating is in order. I wouldn't see this as an all or nothing type of situation.

Not major changes. There are some minor differences on delivery and acceptance rules but the basic principle under validity is the same. Either Rubio has a clause in his contract that disallows his performance rights to be transfer or he can only argue that the contract was invalid in the first place. Which is doubtful that he will win this since he perform under the contract as though it was valid. Performance wins out. Not sure what other redemies he is seeking.

there have been other cases where the Euro player has arbitrated and/or sued (can't remember which) that his buyout was too high and got it lowered. I'll try to find article.

There is no issue about whether he is coming, it is just starting to hit him about the reality of him coming this year or not. I am sure he and his people are scared about the possibility of trying to negogiate with a governmental agency vs a private partnership.

This year I think for sure. There just seems to be too much pull from this side of the Atlantic for this not to be resolved before the season starts.

My problem with this hold situation is why did he wait this long to sue is his team about his contract situation. This whole situation has gotten way out of control and we don't know how this thing can be resolved I mean this 15 days before draft and he hasn't even worked out with a team yet. Getting back about draft rubio or traded up for rubio it is not good idea do it because we can't wait for a year for him and we need and impact player now not later. You have to think that donnie walsh and mike dan datoni doesn't want deal with another contract issue and contract issue that they aren't allowed to handle. I think if we are trading up for the second pick I think donnie walsh will select thabeet. Also this is a playoff year and we don't have a first round pick next year so it better to get player that you know that going be there and can help make immedate impact know rather then later.
