Source: Donaghy to plead guilty

NEW YORK - Former NBA referee Tim Donaghy planned to plead guilty in federal court on Wednesday to charges alleging he wagered on games he officiated, a person familiar with the betting scandal probe said.

Donaghy was to surrender at Brooklyn federal court, the person said on condition of anonymity because charges had not been made public yet.

NBA spokesman Tim Frank told the AP the league was informed Tuesday that Donaghy would plead Wednesday but was given no further information.
-----------------------------------------------------------------------------
I guess all this time that has passed gave the NBA, Stern and other liars and smucks a chance to cover themselves better.

David Stern knew Donaghy was gambleing on these games only tells me one thing.

David Stern showed no remorse for the Phoenix Suns and their fans even when he knew that he was the Ref in Game Three against the Spurs.

So he knew that going into game four. When he hit the Suns hard with two ejections in one game and did nothing to change the course that was so handed down from Donaghy calls that were so bad in game 3 that everyone could notice the bad calls or no calls. Stern still gave the Suns two ejections.

The point here is that David Stern knew all along, that Tim Donaghy was a criminal and cheating the points spread. When he made the decision to eject Stoudemire and Diaw.

The whole (inappropriate term)NBA is rigged

From the moment the Donaghy scandal broke, Stern entered a new era of his tenure. The innocence is gone. The unthinkable has occurred. It reminds me of the moment when FBI agent Robert Hanssen was discovered to have been working as a spy for the Russians. The space between “How could this happen?” and “How can we make sure it never happens again?” was a matter of seconds. The FBI immediately instituted a new policy requiring random polygraph tests to all its employees. In a symbolic gesture, the FBI director at the time, Louis Freeh, took the first one.

I’d like to see David Stern hooked up to a polygraph — just as a symbolic gesture, of course. I think he’s an honest guy who is incapable of lying. But I think he’s definitely capable of deluding himself into thinking everything is peachy.

And then I’d like to see the rest of his employees who are directly involved in the outcome of basketball games — officials, coaches, players — undergo the same tests. It may not be necessary. They might all be squeaky clean.

But what if Tim Donaghy comes up with information that implicates other referees in a larger betting scandal? There is going to be a lot of pressure on him to provide evidence to the FBI. The NBA referees who know him fear he will implicate them in a larger betting scandal -- whether or not they were involved.

"We know who we are dealing with,'' said a highly placed league source, who is "very concerned'' Donaghy would escalate such a case into a modern-day Salem witch trial.

"We always said if he goes down [for anything], he's going to take other people with him," said a member of Donaghy's former golf club in suburban Philadelphia who asked not to be named.

Much has already been written about Donaghy's misdeeds, including allegations of assault against a mailman. (The case was dropped because Charles Brogan failed to show up for a court hearing.) In January, 2005, Donaghy's next-door neighbors in suburban Philadelphia sued him for harassment and invasion of privacy for a pattern of discord that had reportedly gone on for several years. Peter and Lisa Mansueto claimed Donaghy vandalized their property and stalked them, even to the point of following Mrs. Mansueto around Radley Run Country Club, where Donaghy and the Mansuetos were members. After an internal investigation, Donaghy was suspended from Radley Run for the summer and early fall of 2004. The suit also alleged Donaghy set fire to the Mansuetos' lawn mower and crashed their golf cart into a ravine. (The lawsuit was dropped after Donaghy moved away.)

Donaghy surrendered early Wednesday for an appearance Brooklyn federal court, the person, who was not authorized to speak publicly about the case, told the AP on condition of anonymity.

The charge to which Donaghy would plead was not immediately known.

NBA spokesman Tim Frank told the AP the league was informed Tuesday that Donaghy would plead Wednesday but was given no further information.

Donaghy already start talking and the first new stuff which came up is that he consulted the illegal gambling ring on the future games outcome based on his knowledge of player’s physical and mental conditions, certain referee’s personal opinions about the players and coaches.
This suggests that the line to cover up others involved in NBA will be to switch the focus from fixing games to "consulting the gamblers"...
Nice strategy. It might work zo.

NEW YORK, August 15 – NBA Commissioner David Stern has issued the following statement:

“As expected, former NBA referee Tim Donaghy pleaded guilty today to betting on NBA games, including games in which he officiated, and providing confidential information to others who bet on NBA games. We will continue with our ongoing and thorough review of the league’s officiating program to ensure that the best possible policies and procedures are in place to protect the integrity of our game.”

From a Department of Justice press release:

Approximately four years ago, [Tim Donaghy] began placing bets on NBA games, including games he officiated. At his guilty plea proceeding this morning, Donaghy admitted that in approximately December 2006 he began to receive cash payments from his coconspirators in exchange for providing them with betting recommendations or "picks on NBA games, including games Donaghy officiated. Donaghy and a coconspirator agreed on a code that Donaghy would use over the telephone to indicate his picks. Donaghy admitted that he received payments from his coconspirators for each correct pick. Donaghy received no payment if his pick was incorrect. In determining his picks for NBA games, Donaghy admitted that he relied on nonpublic and other information to which he had unique access by virtue of his position as an NBA referee. That information included his knowledge of the officiating crews for upcoming NBA games, the interactions between certain referees and certain players and team personnel, and the physical condition of certain players.

The same release also says that James Battista and Thomas Martino are also being charged with participating in "the NBA betting conspiracy." Battista and Martino both reportedly went to the same high school as Donaghy.

In an affidavit in support of arrest warrants for Battista and Martino, FBI Special Agent Paul Harris describes the findings of his investigation. For instance, here is some of what is alleged:

* The affidavit is littered with references to CS-1. That's "confidential source one," further described as a 13-year NBA referee. Hmm ...
* According to CS-1, the referee and a friend made wagers beginning in about 2003. The friend had contact with a bookmaking service (identified as professional gambler who is also a confidential source for this investigation, or CS-2, see below), and set up the account so it looked like it was all his money.
* In the middle of last December, Battista, Martino, and CS-1 met in Philadelphia. At the meeting, says the affidavit: "Battista confronted CS-1 with the fact that CS-1 was betting on NBA games through CS-2, and proposed that CS-1 provide picks on upcoming NBA games to him (Battista) in exchange for $2,000 for each game picked correctly, and no payment for each game picked incorrectly. CS-1 accepted ..." That must have been some lunch! Several weeks later, says the affidavit, the amount was increased to $5,000.
* Martino was agreed on as the go-between, so that the referee and Battista would not have direct contact.
* Martino delivered money to CS-1 at various times as CS-1 traveled refereeing NBA games, including in January 2007 in Phoenix, March 2007 in Toronto, and April 2007 in Washington DC.
* CS-2 is a professional gambler who plays an interesting role here. He learned of the arrangement somehow, and talked to Battista about it "in or about March 2007." Battista asked CS-2 to also pay Martino for betting information, and "CS-2 in fact provided a sum of money" to Martino.
* Almost forgot: The best part of this whole document is the news that James Battista is allegedly known as "Baba" or "Sheep." Big-time gamblers with nicknames! FBI Special Agents! Has the NBA ever been better suited to a major motion picture?

The lead negotiator and spokesperson for the National Basketball Referees Association, LaMell McMorris:

"Tim Donaghy's former colleagues on the NBA's officiating staff are deeply saddened to learn that he pleaded guilty today to wagering on professional basketball games and providing others with non-public information on those games. This is a truly unfortunate case of wrongdoing by one of our own who has admitted to having a serious gambling problem. We recognize that a cloud has descended upon all referees, but we are committed to showing the public that this was an isolated event and that NBA officiating is conducted at the highest levels of honesty, integrity and fairness."

This statement is a killer.
In between the lines it actually means the NBA system is fundamentally flown as the things mentioned above can IN GENERAL affect the outcome of the games.
Is this even worth that the crime? Totally disgraceful...

They come way short of saying Donaghy was involved in point shaving etc. Basically they are accusing Donaghy of nothing more than what amounts to "insider trading".

Yeah, if anything it sounds really waterdown than what was anticipated. For example he gave his recommendations for which team he thought his associates should bet on due to the factors such as player/official relationship and injury reports. It appears that he was only paid if his recommendation was right. Well, I guess he had a 50% chance of being right each time. How good are these gamblers to put stock in a system like that.

It looks more and more convincing to me that he had associates among other referees, NBA officials, and clubs officials too.
Just knowledge of who will officiate and how players are feeling today will not make any money.
But having officials and players fixing things will. And you need somebody to set "right officials" to work on specific game. So you need somebody to arrange this.
And to know the player’s conditions you should have somebody on the team (player or coach, etc.)

A player's status is known to the team. To be honest, you can say you know just as much as any official based on coverage of a team. So basically, if he is telling them to put money on a team because Player A is on the DL is not inside information. You can get that info from any betting site or 900 number. Fantasy BB players have that same info. The fact that his work was reviewed by the league, Nunn and Jackson and was given a high rating puts doubt how much impact he really had on games. Unless you now bring those people into suspicion as well.

That's why I am questioning, just how real are these guys. It kind of makes sense when they were first described as wanna be gangsters. I thought maybe he was shaving points but it looks like the NBA reviewed his games and gave him a high grade for officiating. The worst thing here is that he bet on games he officiated. Now in the grand scheme of things this could be far worst if his games weren't reviewed and audited but since they are and the NBA concluded that he was one of their better officials than that opens up questions such as that people like Ronnie Nunn and Stu Jackson would have to be involved in this mess. I know if I was paying someone to fix the game I would want a lot more than just scouting and injury reports. I have more issue with trainers giving inside tips on horse racing than that. He is trouble because he bet on his games and gave recommendations not for fixing them. At least that what he pleaded to.

Exactly...
And my point is if he never fixed the games but gets paid - somebody else did fixing.
I think he NEVER fixed the games he himself officiated. So they were reviewed and was OKed.
This is how mofos work - they are not idiots (like some other people).
His body referee (probably some gray assistant or replacement-intern) is set to work the game (probably by his body coaches union).
The guy gets his share of money, do his thing and sit quiet.
When the mofos are finally in trouble they have their e..th covered... Cool stuff...
As usual the only crime he did - he never paid taxes o this transactions. Old Gambions story.

When David "the don" Stern came out and called Donaghy a rogue ref and said he believed it was an isolated case RED FLAGS went up for me right there.

How can he make a statement like that without knowing? Stern looked awful, like he knew he was done as commish, when he came to his news conference on july 20th.

In the mob , they like to use the term "betrayal" when somebody starts to snitch and this is the term Stern used against Donaghy..

Obviously there are other involved, but to drop the hammer on one saves the integriety of the game if they keep their noses clean.

I would think if an 8-10 yr marginal bench warming vet in the NBA who watch more of the game than they actually play would be interviewd with anonymity, when this case was 1st exposed they would have stated how they thought games were fixed or refs changed the outcome of games regularly.

"I would use a telephone or cellphone to make calls around the country to one of the individuals in order to communicate the picks," Donaghy said. "(In) many of these calls we used a coded language, and I concealed this conduct from my employer."

Donaghy said he "was in a unique position to predict the outcome of NBA games" because he had access to information not available to the public. "As a referee, I was given access to master referee schedules that included the identities of officiating crews for particular games," he said.

Hue Hollins, who retired as an NBA referee two years ago after 27 seasons and officiating 19 NBA Finals games, said referees usually get a 30-day schedule that only includes their games and those working with them. "Somebody must have given him a master schedule," Hollins said. "I wouldn't doubt it. I wouldn't know who was working from one game to the next."
---------------------------------------------------------------------------

Don't tell me no one else is involved!

Why don't we know which games Tim Donaghy bet on or if he influenced the outcome of games?

The investigation is ongoing and the FBI may want to use that type of information to ensnare others.

Then Playa, you are accusing Stern, Stu Jackson, Ronnie Nunn, various members of the officiating crews and to an extent the FBI of covering up point shaving scandal. In order your theory to work, there has to be collusion from the top to point of investigation as well. I am not surprise that Hue Hollins didn't have a clue, if anything some would expect his name to be mention as a possible candidate for corruption. A very controversial official in his own right.
