I might not ask him to sit out from the NBA for five years- I'd compromise and have it be 3 years- I mean if you're orlando and your second choice is Stan Van Gundy, you know your team is going to start to tune out Van Gundy in about 3 years- don't burn bridges.

Why would you even consider him again? So that he can change his mind again at that time? No. He lost his chance and I hope no NBA team ever considers him again.

Magic say they will welcome him back. Sounds silly to be doing that and holding him to his contract. Why even want a guy that does not want to be there. Makes them look bad.

The Orlando Magic should put in the contract that will be broken, that not only can he not coach in the NBA for 5 years but he can't coach college for 3.

It looks like David Stern wants him banned for the term of the contract. Makes sense to me. He signed a legal binding agreement to only change his mind less than 3 days later. The NBA is still a business. Players aren't allow to do that so why should any coach be allowed. College coaches are so full of themselves, they think they can get away with this crap and go on about business as usual.
